What kind of a Lawyer do I need for a discrimination lawsuit? Do I even have a case?
I am hispanic, and was hired by a company and subsequently moved 1000 miles in January to where their corporate headquarters is located. I was the only non-white employee in the group and shortly after I started there were comments made and emails sent regarding my ethnicity. They were said in jest and at the time I tried to play them off as such, as the weeks went on they got more derogatory and offensive. Wow, it does seem like you were discriminated against. I think you can have a case. Why not call 1-800-Lawyer, see what they say. They may have lawyers in your area.
If you have kept the e-mails for evidence, or have credible witnesses that will testify for you, you may have a good case. However since the lay offs were apparently happening anyway and you had only been there six months, it will be very easy to say you were let go because you had the least seniority. The fact that the manager moved into your office and took over your old job could actually support that conclusion. You should contact the Bar in your state and see if they have a referral service (check the web). If they do ask them to refer you to a labor attorney.
Maybe not discrimination … that implies it had to do entirely with racial issues. I would suggest you have a case of wrongful dismissal. You’d have more of a chance with wrongful dismissal because it takes on broader causes than discrimination. In any case, I’d start with the previous answerer’s suggestion of the 1-800 line, then go from there.
Did you write down everything, what other employees said to you ??with the day and time ?? Did you keep all the e-mails ??? Do you have any proof, of what happened ?? Did you read your employees hand book ??? If you have ,, call the Fed. EEOC.. They will help you… No Company in the United State’s wants to deal with the EEOC and when EEOC tells you,, have a case… Any and all Lawyers will come running to you….
This is a fact sensitive “get a lawyer question”. You would want an employer that specializes in employment/labor law.
However, as _you_ tell the story you have no case. When you contact the lawyer, you are going to need to explain how your firing was the result of discrimination.
